ELIGIBILITY:
The "Wish you were here?" Event Planner 1,000,000 Bonus Point Offer 2013 (the "Offer") applies only upon request by or offer to the Booker to Bookings (as defined below) made by a Booker (defined below) at participating Waldorf-Astoria Hotels & Resorts, Conrad Hotels & Resorts, Hilton, Hilton Garden Inn, Doubletree, and Hampton Inn hotels in Europe, Middle East and Africa, EXCLUDING Bookings for properties located in Sweden. For a full list of participating hotels, please visit hiltonworldwide.com/wishyouwerehere/en. Void where prohibited by law. Not open to employees, officers or directors, or to members of the immediate family or household (whether related or not) of any employees, officers, or directors of Hilton Worldwide, Inc. ("Sponsor") or any of its parents, subsidiaries, affiliates, franchisees, or any advertising, promotion or other agencies or suppliers involved in this Promotion (collectively, the "Offer Entities"). Eligibility may be confirmed at any time and ineligible participants excluded. No transfer of Bookings allowed.
DEFINITIONS:
As used herein, the following definitions apply:
"Bookings" – New business meetings or events bookings that: (1) are made and confirmed between 1 March 2013 and 31 May 2013; (2) take place between 1 March 2013 and 31 December 2014; (3) are a minimum size of 25 delegates; (4) are paid in full within 30 days of completion of booking; and (5) total – either all qualified Bookings cumulatively or individually – at least 500 delegates and a minimum spend of $100,000 (excluding spend in unmanaged outlets or outside catering). Bookings are "confirmed" when the event hotel receives the signed event Booking Contract back from the Booker. Offer does not apply to "no show" or cancelled events irrespective of whether a credit card is charged/payment made for any portion of the meeting per the hotel's "no show" or cancellation policy.
All Bookings are subject to the hotel's standard terms and conditions. Rates and event spaces subject to availability. Blackout dates may apply at hotel properties. Offer cannot be combined with any other promotions or discounts except for the 20% off promotion being offered simultaneously with this Offer. Bookings must be made either: (i) directly with the hotel; (ii) through Booker's Hilton account manager; or (iii) through the relevant International sales office. Booking may not be made online. Offer applies to an individual Booking or multiple Bookings of combined value. Offer not valid for events/meetings previously booked.
"Booker" – The individual designated in the Booking Contract as the "Booker" for the booking entity and who is, at that time, employed by the booking entity and officially registered as a current Booker under the HHonors Event Bonus Programme. Residents of Sweden are excluded from this Offer. The Booker does not have to attend the any of the events/meetings that are part of the Booking(s) to be eligible. Offer cannot be combined with any other promotions or discounts.
NOTE: Booker must obtain express prior written approval on the official Hilton Acknowledgment Form from employer/booking entity before participating in this Offer. Failure to provide this written approval prohibits Booker from participating or receiving any Bonus Points.
HOW IT WORKS:
Sponsor will track the confirmed Bookings of each Booker through qualification. Upon final payment for each Booking, Booker will be credited for that Booking. Sponsor retains sole discretion in tracking and awarding credit for qualified Bookings. Only one individual will receive credit for any Booking; no sharing or splitting credit allowed. Sponsor's decisions are final.
AWARD:
1,000,000 HHonors Bonus Points. (Approximate Retail Value: US$10,000). Limit one Award per qualifying Booker. Bonus Points will be deposited in the Booker's HHonors account within 6-8 weeks of occurrence of, and full payment for, the total Booking(s) that qualify Booker for the award. In the event that multiple Bookings are required for Booker to qualify for the 1,000,000 Bonus Points, Bonus Points will be deposited within 6-8 weeks of occurrence of, and full payment for, the last Booking resulting in qualification. Hilton HHonors membership, earning of points, and redemption of points are subject to HHonors Terms and Conditions, at http://hhonors1.hilton.com/en_US/hh/terms.do. Bonus Points earned on Base Points do not count toward elite tier qualification.
To the extent allowed by law, Bookers are solely responsible for the payment of any taxes that may be due as a result of the acceptance or use of Award. Award is non-transferable and no substitution is allowed, except Sponsor reserves the right to substitute award for one of comparable or greater value if the award becomes unavailable. No responsibility is assumed for cancellation of any award-related events beyond Sponsor's control. If any qualifying Booker is found to be ineligible, or if he or she has not complied with these Terms & Conditions or declines the Award for any reason, such Award shall be forfeited. The Hilton Worldwide, UK and Ireland commission applies to licensed agents.
AWARD NOTIFICATION:
Bookers will be notified no sooner than July 1, 2013 if they have booked enough Bookings to be eligible for an Award. No Award will be given until all required qualified Bookings are paid in full. Sponsor's decisions are final.
GENERAL PROVISIONS:
To the extent allowed by applicable law, acceptance of an Award constitutes winner's permission for Sponsor to use participant's name, photograph, likeness, voice, biographical information, statements and address (city and state and country) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity (or for as long as allowed under applicable law), without further compensation except where prohibited by law. Participants agree, to the extent allowed by applicable law, that neither Sponsor nor the Offer Entities shall be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, from participation in the Offer or any Offer-related activity, or from participants' acceptance, receipt, possession and/or use or misuse of any award.
No responsibility for any damage to a participant's computer system that is occasioned by participating in the Offer, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or award notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.
Sponsor reserves the right in its sole discretion to disqualify from this Offer and any other offers of Sponsor, any individual who is found to be tampering with the booking process or the operation of the Offer, to be acting in violation of these Terms & Conditions, or to be acting in a disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Offer, or to annoy, abuse, threaten or harass any other person. No mechanically reproduced, illegible, incomplete, or forged bookings will be accepted.
In the event of a dispute as to the identity of the Booker, the Booking will be deemed submitted by the identified Booker on the Booking Contract. If no Booker is identifiable in Sponsor's sole discretion, no Booker will receive credit for the booking.
Sponsor reserves the right to modify, extend, suspend, or terminate the Offer, in whole or in part, if it determines, in its sole discretion, that the Offer is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Offer as contemplated herein. If the Offer is terminated before the designated end date, Sponsor will (if possible) provide Awards to any then-qualified Bookers unaffected by the problem.
By participating in this Offer, you agree, to the extent allowed by applicable law, that (i) any disputes, claims, and causes of action arising out of or in connection with the Offer, or any award, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Offer, but in no event attorneys' fees; and (iii) under no circumstances will any participant be permitted to obtain any award for, and participant hereby waives all rights to claim, punitive, incidental, indirect or consequential damages and any rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses. These terms and any disputes relating hereto are governed by the internal laws of the State of New York, USA, without regard to principles of conflicts of laws, and by entering you consent to the exclusive jurisdiction of the state and federal courts in Eastern District of Virginia, USA, or if there's no federal jurisdiction, Fairfax County, Virginia, USA for resolution of any disputes relating to the Offer and waive any objection thereto to the extend allowed by applicable law.
